Honestly it’s a nightmare and still on going. The paying parent didn’t attend court or follow any of the issued directions. All the courts have done is keep issuing them. This year he attended court still not providing the courts with the requested bank statements and I have been waiting two months now for the next set of directions. The judge hasn’t Indicated an outcome but I have requested a court appointed financial accountant go through all his accounts. It’s honestly a broken system.
Since then in the background I have raised multiple mandatory reconsiderations on every decision. I even had the paying parents latest tax return that was rejected by CMS even though showed an increase of almost 100percent.
I have got my local MP involved, the child maintenance financial investigation unit and CMS are still a nightmare. All the time it is a constant battle.
I have since educated myself on there policies and have become quite knowledgeable through joining some CMS Facebook groups.
The only advice I can really give is to contest everything even if you have no evidence at the time. By the time court comes you will have the next years finances etc and hopefully more information.
