    Right so at the hearing, the Magistrates decided that my ex’s Hair Strand test result was inconclusive so she was ordered to do another ahead of our final hearing on 20th December. We’ll have the result soon and I assume it will show she’s been sober as we’ve had no trouble from her since August. So at the final hearing I am going to support her having unsupervised contact either at her home or an agreed public setting, e.g play centre/cinema etc, but under no circumstances allow her partner around the children for the following reasons

    • He has had 2 separate safeguarding checks done, and each time he has been arrested for assaulting my ex (grabbing her by the throat, spitting in her face, injuring her wrist)
    • I have a transcript of a tape recording between the 2 of them, where he states he doesn’t have to listen to me or the court as we “have come in and not understood the situation”
    • They have both deleted all the messages surrounding a photo of my then 8 year old daughter asleep in her underpants that my ex took and then sent to him
    • The same daughter, now 9, doesn’t know about the picture, but is currently on the wait list for counselling (her school support the referral) for anxiety, and has expressed to CAFCASS she will feel anxious around the partner
    • The two of them broke a previous agreement that he would not sleep overnight or be alone with the children. They broke both of these conditions then denied the agreement existed, luckily I saved the screenshots and have provided them to CAFCASS. this was after my ex was shown to be sober by Hairt Strand Testing
    • My 7 year old autistic daughter is showing troubling behaviour, including worries “that tell her not to talk to grownups “.

     

    Has anyone had a similar experience? I’m wondering how likely the court is to allow the partner to be involved in their mother’s contact, as both of them both aggressively seek to have him involved, and the partner is almost the sole focus of my ex’s statements to court

     

    Any advice would be appreciated, thanks in advance and sorry for another essay!

    Thanks for all the advice. I’m just concerned about liasing with the Court, submitting evidence etc. Is it relatively simple to do?

    We have important evidence like a transcript of the recording (my ex and her partner discussing abuse etc) that I wouldn’t want to be inadmissible because I submitted it incorrectly or something
