Does he see her in the weekends? The five days a week she is with you are all school days? In this case there is no logistical issue. Do you live in the same town as him at the moment? Does he help or get involved in any way aside from the 2 days per week? Is there an advantage for him and your daughter to live in the same town? Like random outings or help with pick ups/ drop offs or meet you both at the park?
40 minutes is not that much to be honest.
