I’m currently going through the court process for child arrangement order, my ex husband took my kids off me against mine and their will and they currently live with him 20days if the month in a 1 room annex where as I have a 3 bedroom house empty. The last court hearing the judge requested myself and my ex provide gp medical history and also letters from any third parties that we currently get help from (Councilling etc)
I have done ALL of the above and handed it to the judge in court but my ex husband has not, I have court hearing again in a couple of weeks where even social services report states that it should be 50/50 split as I’ve requested BUT as my ex has not handed in his paperwork from gp or anything will it be the arrangement we currently have stay in place for another few weeks to give him more time or will they do the 50/50 from this hearing?? It’s not my fault that he hasn’t given in the documents requested an he’s has the same 12 weeks notice to do so as I have so I don’t see why I should be punished by withholding the kids from me for longer because he hasn’t done it if that makes sence!!
I currently have my kids once a week overnight and then every other weekend, if he hasn’t done as he was ordered to do I think it’s only fair we swap roles until he does it, they should come home and he should have the once a week and every other weekend as it would be him stalling the 50/50 process
