Well, when I first posted this question I hadn’t received an application from other party, she just made threats that she’s going to make an application and because she has consistently breached I was going to make a claim myself. I’ve received her application in the post yesterday so I emailed the court asking to discharge my application as other party has already made one, we’ll see what happens.
Regarding am I opposing her application, yes, yes I am. She has made false allegations of abuse and child abduction against me. Our son lives with me majority of the time and she has weekends, which is already a court order, the order clearly doesn’t work for her as she often gets him to school late which affects his education (none of which was her reasoning for the application btw). She doesn’t act within his best interest and on one occasion when I was abroad she was due to collect our son from school and she didn’t, when I asked her as to why, she told me social services can pick him up, which left me having to ask my parents to pick him up and leaving my holiday earlier than planned, yet I’ve abducted him. There’s so many allegations of abuse, everything she could have clicked on the application she did and as a “concerned mother” she did not do anything about such abuse, did not seek help, does not want protection and is happy for our son to still be in contact with me, even though allegedly I’ve done/doing all these things to him, all she wants the court to do is to change the school, and discharge my child maintenance claim against her. Honestly, I cant make this up, surely this in itself is abuse, not really quite sure what my options are atm, its just very overwhelming to say the least.
