My husband and I are getting a divorce. For the past 5 years I have been a stay at home mum caring for our 3 children. He earns around £40,000 a year and owns the family home outright – he had this before we met so I’m not included on the deeds etc. What are my rights? Feeling pretty low as I’m thinking I’ll be financially screwed. We have a joint account and some savings which he has put in an ISA in his name over the years – was it stupid to let him do this? Never expected we’d divorce and he already had this savings account before we met. Any advice appreciated!

If it were just the two of you, and he had owned the house prior to you getting together, then you probably wouldn’t be entitled to much. However you have THREE children together. He is as responsible for housing & providing for the children as you are.  Any money saved during the marriage is shared too.  Which name it is in, is irrelevant.

Get yourself some legal advice. Or check with the CAB, Gingerbread hotline etc.
