I am looking for advice following separation from my partner. We have a property in joint names and 3 children. The current situation is I reside at the property (due to occupation order) with the 3 children. The property is currently on the market. There is a prohibited steps order in place for the children as they are at risk of being removed by dad. The hearing for the child arrangement order is due to take place on 21/3/18. There is a deed of trust on the property as I provided a substantial deposit though my ex partner is now seeking 50%. My ex partner has refused mediation. I have offered him a generous amount to ‘buy him out’ so I can stay at the property with the children, though he has declined the offer. How am I best enforcing a deed of trust without hanging myself over the cost of attending court? I’ve been advised this will be in excess of £7000. I’ve already paid for the occupation order and I’m expecting a bill for child arrangement order hearing. Thanks
