    Please help,

    Hi,

    my two youngest of 5 and 10 have asked for one more night on top of the two a week they spend here. Ex has ignored requests, mediation and any negotiations at the first hearing..cafcass wont get involved because no threats to the kids, so a wish and feelings report not possible..it’s basically going to be my statement against hers at final hearing which is daunting..anyone with any experience or advice on here , please I need help, thankyou

    Hi have you got evidence of mums refusal to additional time (text/email) or written evidence of your request (including those ignored), if so then I would take these to court to present. I did read your earlier entry and wondered whether the Mackenzie friends might be able to advise. My next thought was, if you live close by it won’t be long and your 10year old will be going to high school and develop hormones and a mind of her own, so even if mum does put blocks up, it potentially will be short lived. I think courts tend to balance care between parents where possible so long as it’s in the best interests of the kids.

    No evidence needed, her lawyer refused point blank to negotiate, is it just my statement vs hers and a decision? Cross examination?

    I’m not sure but I imagine there will be some cross examination in order to finalise the plan going forward. Sorry I can’t be of more help, I’m due in for my final hearing mid oct but  thinking you’re probably going to be there sooner?
