    I thought I’d post an update. Firstly, at my request, my original post has been edited to protect my identity, so doesn’t really make as much sense anymore.

    secondly, it has become apparent that my ex has NO intention of changing his working pattern for additional access to our son! We have both attended MIAM meetings and we’ve got nowhere doing so. We are now in the process of going to court. We have to attend our first hearing next week. I applied for a SIO and a CAO. We have both spoken to CAFCASS and there are no safeguarding issues. It’s going to be a long week. Thanks to all, for your comments.

    Hello, we’ve offered to take turns with the travelling and my brother has offered my ex a room at his whenever he wants to lessen his travelling. He can stay there with our son. Let’s wait and see.

    Hello. Quick update. After my court visit last week we are no further forward. Even after advice from his solicitor that I have a strong case to relocate, he would not listen. Two more court dates to face and my son has to talk to cafcass. Does anyone know how it will be dealt with by cafcass? Don’t want my son upsetting.

    Is anyone aware whether or not you can be penalised for late return of a position statement?

    Marpus – Position statement if you’re instigating the hearing can be handed in on the day but first thing to give everyone chance to read it. Response will have a set date agreed in court. If it isn’t presented in time it may be ignored, though response statements to a position statement aren’t as necessary unless you’re adamantly refuting statements, so it’s in your interests to get them in on time. If you don’t have a position statement on the day as instigator your case may be deferred and it won’t look good on you. Your legal representative will normally have chased you on this.

    Hi All,

    I wonder if somebody could assist:

    Short version: mother has moved to Greece to start new life with her new boyfriend. We are due to have our first hearing which she will no longer attend. What is likely to happen? Can I ask the judge to make a final order stating the child will live with me?

     

    longer version:

    1. I have had my child with me every weekend and sporadically during the week as the non-resident parent since our split up last year.

    2. In April, she met a fella on tinder and decided to move 200 miles up north with him. I manage to get a prohibited step order and my child has been with me ever since.

    3. Our first hearing is schedule for September and she decide to move to Greece now and has emailed me to confirm she happy for my child to live with me and that she will no longer contest it. All she asks is that we make contact arrangement for visits in the summer holidays etc

    4. She has history of cannabis misuse etc.

     

    Does anyone know what a judge is likely to do considering ? Oh, Cafcass is due to start their safeguarding letter soon too.

    Hello, I thought I’d give a quick update. My son has had his meeting with cafcass – they took him into a separate room to chat which pleased me to be honest as I wanted him to be honest about his feelings and thought he would struggle to express them if I were with him. Cafcass has spoken to my ex and am now awaiting to speak to them myself. Apparently my son has said that he’s wishes to move and this is why cafcass spoke to my ex first.  You s this the ‘norm’? Does anyone know if the court would listen to my sons wishes and feelings?
