Hi, this is my first post and I’m hoping that someone might be able to share their experience.
I contacted CMS over a year ago when my ex had missed 17 months of the informal child maintenance agreement we had.
I am getting nowhere. My ex was on a substantial salary, so the initial maintenance calculation was a significant one. He’s a financial advisor and he then went self employed. His assessed monthly contribution went from several hundred pounds to zero. I didn’t get anything. 15 months later, CMS have enforced nothing. I asked to go collect & pay, but was told that as he didn’t want to do that, they wouldn’t enforce it. I work full time, don’t claim any benefits and now face having to sell my house to make ends meet. How can this be right? It is so frustrating. He lives in a house that is easily worth 3 times mine & won’t even send her a Christmas card.
I’m having similar problems. My ex is earning £50000 per year but had fiddled it so his documents show he’s earning £12600 per year. I’ve argued with CMS saying he’s obviously fiddling it as he’s trying to say he’s earning well under minimum wage now etc and I was just told that I shouldn’t be relying on his money. I’m struggling to make ends meet while he’s holidaying all over the world and wearing designer clothes etc. It’s supposed to be a legal requirement to support your children financially so I’m baffled how so many are allowed to get away with this with zero consequences.
