    Hi, my husband left me & our 10 year old daughter 3 weeks ago. He had agreed to pay half the mortgage, now he is refusing as says he can’t afford to. He says I should pay his half out of my child maintenance payments, which don’t actually cover all his half. Does anyone know what my rights are please? Does he have to pay for the roof over his daughter’s head?'</h1>

    I have a joint mortgage with my ex husband (I still live in the house with our child). I have been told that legally he doesn’t have to pay half of the mortgage even though his name is against it. But it is in his interest to, because if the mortgage payments get behind then he is also liable. The mortgage company aren’t interested in who pays as long as they get the money. Sorry I can’t be of more help. Maybe try universal credit? If its a private mortgage then they won’t cover it, but you may be able to claim single parent benefit which would free up your other money to pay the mortgage xxx
