    Hi im newly single and  a mum of one, ex currently still living with us as he wont move out unless I transfer money for bills to his bank. He works nights so its not AS awkward as you may first think. Im sitting down looking at my finances and my ex said he would leave if i pay all of the bills and half the mortgage (both names on mortgage) Does he still have to pay child maintenance if he contributes to the mortgage? Hes under the impression as long as hes paying half the mortgage thats a contribution towards his son and he doesnt have to pay CM. Is he right? please help!

    Err, no, if he is named on the mortgage, he has a contract with the mortgage company to carry on paying his share of the mortgage until the house is sold. If he fails to do so, it will hit his credit rating and make it hard to rent or borrow in future. That has nothing to do with child maintenance. He’s paying for his investment in the the house – which he will have a claim on until you are divorced.

    Having said that, he could choose to stay in the house until it is sold.

    I wouldn’t give him any money until you have spoken to a solicitor.  You may choose to buy him out or sell the house, split the equity and move somewhere else.

    He has to make a separate contribution to the upkeep of his child.
