    Hi all, I feel stuck with regards to being able to get a 2/3 bedroom property through the council so I am able to start having my boys at mine and share custody.

    Long story short, my eldest son (4) suffered a brain injury when he was 2 and spent just over a year in hospital (he is now completely dependent on all aspects of care)  during this time my MH went downhill and social services got involved. I also disclosed DV in my marriage to my kids dad (my youngest is 2). When my boy was ready for discharge he had to go back to the family home as it was adapted for his needs & due to my mental health at the time I was unable to care for both my boys so they stayed with their dad. In order for me to get accommodation through the local homeless center I had to take my name of the tenancy and hand both child benefits to my husband.

    My issue is now they are saying I am only entitled to a 1 bedroom property because I don’t have the child benefit (me & husband agreed to shared custody). I am unable to have them until I have somewhere suitable not only for my disabled son but currently living in a room in a shared house.

    Any help would be much appreciated

    Oh and my husband is refusing to let me have the child benefit of either kids

    That is correct you are only entitled to a 1 bedroom property. If you was to secure a 1 bedroom property your children can stay round for a overnight stay and regularly visit as they can stay on airbeds for the night .

    The reason you cant get a 2/3 bedroom isnt down to if you get child benefit but the fact that dad is resident parent  of children. Even if dad did agree to any kind of shared care it wouldnt entitle you to any benefits whatsoever. i gather this must of surely been in family court .

    My disabled son needs his own bed (air bed mattress). Surely this would mean I need a extra bedroom for him?

    You will not get a 2 bedroom place as your ex partner is the resident parent. If you reversed roles he would be in same situation as you.

    All you can do is privately rent a 2 bedroom property so your son would have a bedroom to stay in.

    Also with your ex being resident parent of both children will be why he is getting child benefit for both children
