Experience of child maintenance service – collect and pay

Just wondering what other people’s experiences are of collect and pay via CMS?
I have had collect and pay set up for my children for several years as he point blank refused to pay anything – initially had a few payments through but he then started job hopping and seems to have got the timing down to a T as at least 4 attachment of earnings have been set up over the last year. Each time they are set up he quickly moves jobs and I have had nothing now for over 12 months.
Annoyingly I’ve had the annual review through which shows his income for the last tax year and it’s a decent figure so even with moving jobs he’s managing just fine.
My question is at what point do the CMS step in and take other action to enforce what he owes? It’s over £10,000 now! It says on the leaflet that was in with the annual review that they have the power to take directly from bank accounts or even through the court. Do they ever do this? Feel like I’m fighting a loosing battle and it’s so unfair on the kids to miss out. I work but money is always so tight.
What’s the point of the CMS if they can’t actually enforce anything?

Each time he hasn’t paid have u notified cms? As they have told me they will take it direct from wages if they paying parent doesn’t pay after 5 days or fails to pay in full I think they get a warning if it happens once but if you have gone that long and you have seen through the review he has earnt money over the year then you should have a case.10 May 2018 at 7:59 am #11146
Yes I speak to them regularly and they just say they will track through HMRC as soon as they find him they set up attachment of earnings to take it straight from his wages trouble is they write to him to tell him they are going to do it about a month before they do which seems to be when he moves on to a new job and the whole process starts again!
Everytime I ring I speak to a new person most don’t seem to know what’s been going on with the case at all and one even told me they can’t do anymore, if he won’t pay he won’t pay! when I asked what’s the point of his job then? he said speak to my MP.

I’m sorry that your going through this it’s so unfair that he isn’t paying as yet mine has paid every month through cms not without threats or awkwardness though you would think they would want to pay for there children but so many paying parents see it that they are giving you money and that’s what they don’t like because they haven’t got the control over where the money is spent because obviously if like mine it goes into household budget my ex believes that I should put it in account and every penny should be on the boys personally even for just treats he doesn’t believe it should help towards rent gas electric food etc he even phoned cms to try and get me investigated and they told him that all those things are for the children too he didn’t like being told.10 May 2018 at 4:48 pm #11199
Hi, sorry you’re having such problems. My advice would be to keep phoning the CMS every week and ask if you have a caseworker – getting a name helps. Keep a note of all conversations and maybe they could apply to take the money direct from his bank account? Saying that, I’ve waited four months for that to happen so not as easy as you may think! Also send an email complaining – you could get a better response than just phoning. I hate phoning them (usually get fobbed off) but make myself do it as many times as I can bear too! Thanks for your replies. I have requested that my caseworker calls me back, they wouldn’t give a name but will see what happens!
