    my ex husband won’t sell the house , I been divorced 6 years this year and I have been trying to sell the house and he refuses to sign the paperwork, he hasn’t paid anything towards it or anything and hasn’t lived here , I have nearly been made homeless twice due to mortage arrears and now I’ve had to borrow money to pay these off , I want to sell and he won’t sign , and threatens me with if I cancel the child maintenance money then he will sign .

    I’m at my wits end and his causes me deep anxiety . >What can I do ? I have sold again and have a buyer waiting for the contracts .

    Was there not a Consent Order or Court Order issued when the Divorce took place that detailed what had to happen with the house?

    Child Maintenance is based on the Paying Parents income.  Nothing to do with assets.  Was child maintenance arranged through the CMS?  If it was then it is binding on your ex.  However, if a mutual arrangement then it is not binding.

    No I represented myself

    when I divorced him and didn’t set anything financial as we only had debts , and I just stayed in the house . I then had a court order made for child contact arrangements which he’s never stuck to .

    Child maintenance payments come direct from Csa from his wages as he never paid so he’s fuming at me cause they charge him for taking direct
