I don’t think my ex husband is paying me the correct amount of child maintenance. I have said that I want to apply to the cms to check if it is correct and he says if I do this I will end up with less than I get now. I don’t know whether its worth the hassle or not or worth the risk of losing the small amount I get. For all I know he could be paying me half or less than half of what he should be. But he says basically either accept what he gives me or I will end up with less and also our relationship (which is quite civil) will be ruined forever. What I really wanted to know is can the cms investigate and work out how much the father should be paying without them actually informing the father they are doing this unless you decide to go ahead with the claim afterwards? Any help massively appreciated!

If you apply to CMS they will have to inform the father as it will have started the process.
He shouldn’t be threatening you like that, that’s controlling behaviour. However, if you share childcare 50/50 then you won’t get anything from CMS at all.
