I’m wondering if anyone can help. Me and my ex have a court order in place, the children live with me and spend time with their dad on set days. The question I have is does the dad automatically have the children if I cannot due to work commitments? The day I am due to work is on a day I have the children in the court order, am I able to get a family member to look after the childrenfor those few hours when I work or does the father automatically have them when it’s not on his set day? Any help would be great if anyone has been through the same thing, I feel very stressed about this and the children do not want to go with him on this day I have to work but he is very insistent that no-one in my family is having them but him.
I’m sorry you have to go through this stress but you might need to apply for the courts to review the order due to your personal circumstances changing. The process for applying for a review of this court arrangement will depend on the jurisdiction. Good luck
when children are in your care, it’s up to you. is there anything in the order that says the children must be with father if your not available? if not then you could get family to look after them, or child minder. why do the children not want to spend time with the father on that day?
