My ex husband is taking the CMS to a tribunal as he doesn’t believe the maintenance calculation is correct. It’s been checked and checked again, the appeal got thrown out. The calculation is correct due to his earnings and tax return etc.
I have received a pack from the CMS with copies of all the paperwork, this was a surprise as it was the first I knew about the tribunal. They have said I can attend and should as a decision might be made there and then. I’m also able to provide a statement. Has anyone ever written a statement like this as I’m unsure what to put on. My ex is claiming he can’t afford their calculation but his income has been capped as he earns that much and he had 7 holidays last year, new house and car. The calculation is fair but he’s claiming not, plus it come to light from CMS paperwork which was sent he lied on the divorce papers about his income to Court. Just need advise what to put in the statement.
