I’ll try and keep this brief! Re-opened case in May this year, no payments received, now with collect & pay, still no payments
Hes self employed but paid via the construction industry scheme, his tax is deducted weekly and earnings reported to HMRC monthly
August ex rings to say no longer working, change refused as he didn’t supply evidence to back this up
Annual review notice – he earns £13 a week. Knowing full well this time isn’t correct I contacted CMS who told me to supply evidence.
I went to town with this, supplied copies of his payments and deductions made via the CIS scheme, his UTR etc which have been submitted to HMRC for every week in this tax year.
I also supplied annual statements going back 4 years showing all his income and deductions
Hes earning over £700 a week, not £13.
CMS say they can’t use this information as its me who’s supplied it, and it needs to come from him.
Nor can they ring the contractor up and ask for them to send the info
Don’t understand why if HMRC have it, CMS are only seeing the £13 a week he receives from a private pension
They also haven’t got the past 4 years figures which 100% have been sent in on his self assessment.
They have re-looked at the decision but informed me today they can’t use the information
Ive no idea what to do now or where to go with it, if providing official documents isn’t enough what else can I do?!
