    i am divorced with 2 children 4 and 10, the existing parenting plan states they stay 2 nights a week with me, 5 nights with mum. They have asked for an extra night a week, mum has ignored pleas, mediation and we are due for an initial hearing. There are no safety issues so cafcass may not ask them but they are central to this, any advice or similar situations please help😔

    If they already stay two nights with you then a judge should easily grant a third night assuming it doesn’t disrupt like school etc. Send a C100 application and apply for a CAO stating you want to increase contact from 2 to 3 nights but mother refuses on no real basis/grounds.

    I have done this, c100 handed in and court date in 3 weeks.. has she got a case purely on the children being young? I said I would not change maintenance payments either…are the children likely to be asked or will they’ve left out with just my word against hers? Thanks so much for your help

    We just do alternate weekends, communication was great too until my eldest started asking mum for extra night and she keeps telling him it’s up to me not her?? Is present arrangement set in stone even though they are asking but court won’t ask them?
