I’m currently in the process of applying for additional income to be considered by CMS. My sons father has a rental property which he’s owned for many years, he bought a second property July 2019 which is his main home now. He moved out of the first house way before July 2019 and rented the property out although only declared rental income officially from Dec 19.
CMA has come back with rental income is less than 2.5k threshold (this has been registered with HMRC). I know that he got cash in hand prior to that for rent.
CMA has asked me to comment through a variation form for them to make a decision as to whether they will take the second property into account. I feel like my son is losing out as they only consider the last tax year and because his father only registered rental income with HMRC in dec 19 – it is showing under the threshold for income to be considered. Hope that makes sense? Any advice on how to approach this with my reasonings for CMS to consider the asset (house) for additional maintenance payment for my son? Thank you.
