Hi everyone, was wondering if any of you lovelies know anything about Child Maintenance. I’m in the process of contacting Child Maintenance regarding claiming from my ex husband for 0ur one year old daughter. By claiming this does this give my ex more rights ??
Hi, I’ve just claimed for child maintenance from my sons dad. Hes 8 months old and his dad has only seen him once and never shows up whenever we arrange anything. He is now saying he is going for joint custody (more than likely to get out of paying me anything) His solicitor has apparently told him that once the first payment goes through then he has his fatherly rights (he is not on the birth certificate) however I have been told that he would have to apply to the courts for parental responsibility. If your daughters father is on the birth certificate he would have the same rights that you do so claiming wouldn’t change anything, but he may want her over night more often as then he would have to pay less. Child maintenance and PR are completely separate. You can claim cm without your ex being on the birth certificate. He could contest it in which case he will have to give a dna sample.
If you were legally married, then I think his parental responsibility is assumed and you already have equal rights.
