    I am after some advice….. I have 2 children, 1 lives with myself and the other with his father.  Since this arrangement I have not received child maintenance even though my children’s father earns a much higher wage than myself.

    Does anyone know how this is worked out or is it just a simple case of making a claim for child maintenance for the child living with me? I would be interested into hearing if anyone is in a similar situation?

    Initially I would try to do this amicably. Explain you’d like to discuss maintenance.

    ultimately if not resolved you’d then make a claim to cms for maintenance. Obviously he’s entitled to make a counter claim for the child with him. Usual deductions for overnights, other children in the household, travel to visit other child, if self employed etc will apply.

    Do you both claim child benefit for the relevant child?
