    Good afternoon.

    I have a child arrangement order in place to see my child. Within the section above “it is ordered by consent” there is a wording of “upon the father agreeing to pay x amount to pay for half the nursery fees”. Does this mean I am legally obiligied to maintain this fee even if it becomes unmanageable and also if the nursery fees significantly reduce because of free child care hours etc.

    There is no child maintenance order in place.

    Any experience would be great.

    Are you sure it’s not a consent order? Ie  Child Arrangements Order that has been reached by consent not court ordered and decided by magistrates. But ratified by the court.

    Why is it no longer manageable?

    I would initially approach as you should be paying half of the fees which is presumably less with free hours?

    Your ex can apply for it be enforced at agreed amount and you can apply for variation.
