    hi, I have had a child arrangement order in place for my ex to see our son for the last couple of years. We have had it altered once due to contact being stopped.

    i am listed as the resident parent on this order.

    things are going well now, but he seems to forget he cannot pick and choose his days with this. Term time works well but recently he decided to book himself a holiday within a half term, knowing he had booked it within his week to have our son. (We had it put it in the order that our weeks within the holidays were to coincide with our weekends). He is able to have our son for 3 of the 7 days he should be having him for. So naturally I reminded him that he has to come home and not be given to someone else whilst he is away (it’s stated in the order the times listed have to be spent with him). He is now asking for the days back that he is missing with him. Do I have to give them back to him?

    I always ensure that I swap days/ give him some of mine and make them up later so he can take our son on holiday and I always make his days back up if I take our son away and he misses some.

    However if I go away without our son, I don’t get my days back that I miss (I have never done this, I go away on my own when I don’t have him) so I’m under the impression it should work the same for him? He is choosing to lose days with him.

    No because the child was available as per the cao.
