    Hi there, just wondered if anyone has had any experience with dealing with receiving maintenance payments from an ex who has their own company? I know most company owners only take a very small wage and take more in dividends. Do the CMS only look at the ‘salary’ rather than the bigger picture? I’m currently being promised a certain amount but (from past broken promises) can imagine this will drop significantly if it will be only based on the ‘salary’ taken rather than the full earnings. Thanks

    You need to make them aware that the ex has that type of income. It may help or like in my case end up that they pay nothing! Just make sure they know where to look

    Sorry to hear that. Was an amount agreed when you divorced that’s now been taken away?

    Hi Hollie,

    I believe they do, but as the above poster said, you would want to make them aware of it.

    I find going through CMS preferable to negotiating a private agreement – my circumstances was that child’s Dad wouldn’t declare his full income to me.
