I am a single father with three children daughter lives with me and 2 sons live with ex. Up until Covid 19 we have had a rota of when each of us had our children and it was working sorta ok. My ex have parents (that do not live with ex) that have had letters to shield on the advice from the NHS so during this period me and my ex agreed that daughter has stayed with me and sons have stayed with ex no swooping between houses to reduce contact. Now the shielding is coming to an end i’m trying to get back to rota and i believe my ex is using the lock down as an reason for me not to have my children over night because of money and the amount of nights the children stay with me 0-52 53-104 etc etc. What can i do or where can i go.

Firstly why did you agree if your ex’s parents don’t live with her? The law states that a child under the age of 18 can go between home unless there is reason to believe the children’s health is at risk or if there is vulnerable people in a home

Now that you have agreed the whole way through lockdown I think the safest option would be to continue to stick with the agreement until further guided by the government to reduce the spread of the virus between two homes. You just don’t know if you, your ex or the children could be carriers of the virus.

However, I don’t think there is anywhere to go with this other than seek the advice of a solicitor.

This is only my opinion and hope it helps.
